Ontario Severance Pay Calculator 2026

ESA minimum termination pay (1 week per year, max 8) and statutory severance (1 week per year, max 26, for 5+ years at a $2.5m-payroll employer), an estimate of common-law reasonable notice by age, service and role, tax on a lump sum and how EI interacts.

✅ Figures verified. Ontario Employment Standards Act, 2000: termination notice or pay in lieu of one week per completed year of service (minimum one week after three months, maximum eight weeks) and statutory severance pay of one week per year including part-years, maximum 26 weeks, where the employee has five or more years of service and the employer's payroll is $2.5 million or more (or 50+ employees are terminated within six months). Common-law reasonable notice (Bardal factors) is shown as a range only. Checked 26 October 2026.

In short

Ontario's Employment Standards Act minimum is termination pay of one week per completed year (maximum 8 weeks) plus statutory severance of one week per year (maximum 26) for employees with 5+ years at an employer with a $2.5 million payroll — about $23,400 for a $85,000 employee with 7 years — while common-law reasonable notice, which applies unless a valid clause limits you to the ESA, is typically close to a month per year of service up to a 24-month ceiling.

Who this is for: Ontario employees who have been or expect to be terminated without cause, and employers budgeting a package.

Not tax or legal advice. The common-law range is a rule-of-thumb estimate, not legal advice — entitlements depend on your contract, the Bardal factors and case law; federally regulated and unionised employees follow different rules. Consult an employment lawyer.

Severance pay in Ontario: ESA minimums vs common-law reasonable notice

Two very different numbers apply when an Ontario employee is let go without cause. The Employment Standards Act minimum is termination pay of one week per completed year (one week after three months, capped at eight weeks) plus — only if you have five or more years and the employer's payroll is $2.5 million or more — statutory severance of one week per year up to 26 weeks. The common-law entitlement, which applies unless a valid contract clause limits you to the ESA, is "reasonable notice" judged on age, length of service, the nature of the job and the availability of similar work — typically around a month per year of service, up to a 24-month ceiling, and much more for short-service older or senior employees.

  • Termination clauses often fail: since the 2020 Waksdale decision many clauses are unenforceable, restoring common-law notice — have the contract reviewed before accepting an offer.
  • Benefits and bonuses continue through the notice period; the package includes pension contributions, car allowances and the bonus you would have earned.
  • Duty to mitigate: common-law damages are reduced by income earned from a new job during the notice period; ESA minimums are not.
  • Tax: paid as salary continuance or a lump-sum retiring allowance (taxed as income; pre-1996 service may be transferable to an RRSP), and EI starts only after the severance weeks run out.
  • Federal employers (banks, airlines, telecoms, rail) follow the Canada Labour Code: two weeks' notice plus severance of two days per year (minimum five days), with unjust-dismissal complaints available after 12 months.

Assumptions

  • Weekly pay = salary ÷ 52; ESA termination weeks by completed years (1 after 3 months, max 8); statutory severance = years + months/12 weeks (max 26) only if 5+ years and payroll ≥ $2.5m.
  • Common-law estimate = service × role factor (0.75–1.3) × age factor (1.0–1.15) × 0.85–1.25 months, minimum 2.5–3.5 months for short service, capped at 24 months; package = (salary + benefits) ÷ 12 × months.
  • Tax on the lump sum = tax at (salary + ESA amount) − tax at salary using the 2026 Ontario engine; EI figures are the published 2026 maximum.

Worked example

$85,000 salary, 7 years and 4 months, age 45, manager, employer payroll over $2.5m

Weekly pay $1,635. ESA termination pay 7 weeks = $11,442; statutory severance 7.33 weeks = $11,986 → ESA minimum $23,428 (plus benefits during the 7 weeks). Common-law reasonable notice for a 45-year-old manager with 7.3 years is roughly 7–10.5 months — a package of about $54,600–$80,300 including $6,000 a year of benefits, i.e. $31,000–$57,000 more than the ESA floor, subject to mitigation. The ESA amount paid as a lump sum attracts about $7,200 of extra tax in the year.

Frequently asked questions

How is severance pay calculated in Ontario?

The ESA minimum is 1 week of pay per year of service (max 8 weeks) as termination pay, plus 1 week per year (max 26) as severance pay if you have 5+ years and the employer's payroll is $2.5 million or more; common-law reasonable notice — usually far higher — applies unless a valid contract clause limits you to the ESA.

What is the maximum severance in Ontario?

Under the ESA, 8 weeks' termination pay plus 26 weeks' severance pay = 34 weeks; at common law, courts generally cap reasonable notice at 24 months (26 in exceptional cases).

Am I entitled to severance after 1 year?

To ESA termination pay of 1 week (2 weeks after 2 years), not statutory severance (which needs 5 years); at common law even a one-year employee can be owed 2–4 months' notice depending on age and position.

Is severance pay taxable in Canada?

Yes — as employment income if paid as salary continuance, or as a retiring allowance if paid as a lump sum (with only the 'eligible' pre-1996 portion transferable to an RRSP beyond your normal room); tax is withheld at lump-sum rates of 10%, 20% or 30%.

Can I collect EI while receiving severance?

Not at the same time — severance (and vacation pay) is allocated to the weeks after termination and EI regular benefits begin once that period ends; you must still apply within 4 weeks to protect your claim.

Should I accept the first severance offer?

Usually not without advice — initial offers commonly match the ESA minimum, and most employees without an enforceable termination clause are entitled to substantially more; a lawyer's review (often free or contingency) typically pays for itself.

What is working notice?

The employer can give notice and keep you working instead of paying in lieu; ESA termination pay covers the notice period not worked, while statutory severance is always paid in money.

Does severance apply if I resign?

No — ESA termination and severance pay apply to employer-initiated terminations without cause; constructive dismissal (a forced resignation after a major unilateral change) may still qualify.
