In short

Federal law pays 1.5× the regular rate (including non-discretionary bonuses) for hours over 40 in a workweek with no daily overtime; California adds 1.5× after 8 hours a day, double time after 12 and premium pay on a seventh consecutive day, Alaska 1.5× after 8, Colorado after 12 and Nevada after 8 for low-paid workers — hours paid as daily overtime are not counted again toward the 40-hour test.

Who this is for: Hourly employees in the US checking a paycheck, California workers with long shifts, and small employers computing overtime correctly with bonuses.

Not tax or legal advice. Gross pay estimate for non-exempt hourly employees; collective agreements, alternative workweek schedules and industry wage orders can change the thresholds. Not legal advice.

Federal and state overtime rules

The FLSA requires 1.5× the regular rate for every hour over 40 in a workweek — there is no federal daily overtime, and the "regular rate" includes non-discretionary bonuses and commissions spread over the hours worked. California adds daily overtime: 1.5× after 8 hours in a day and double time after 12, plus 1.5× for the first 8 hours of a seventh consecutive workday and 2× after that. Alaska pays 1.5× after 8 hours a day, Colorado after 12, and Nevada after 8 only for employees earning under 1.5× the state minimum wage.

Daily and weekly overtime never double-count: hours already paid at a premium under the daily rule are excluded when testing the 40-hour week. The calculator splits each day into straight, 1.5× and 2× hours, applies the weekly test to the remaining straight hours, and compares the result with the federal-only figure so you can see what the state rule is worth.

Assumptions

  • Regular rate = hourly rate + non-discretionary bonus ÷ total hours worked.
  • State daily rules split each day into straight, 1.5× and 2× hours; the 40-hour weekly test then applies only to remaining straight hours (no double counting).
  • California seventh-day premium applies only when all six prior days had hours; Nevada daily rule assumed to apply when selected.
  • Non-exempt hourly employee; alternative workweek agreements and union contracts are not modelled.

Worked example

$22 an hour in California: 8, 8, 10, 8, 12 hours Mon–Fri (46 hours)

Daily: Wednesday 2 h and Friday 4 h over 8 → 6 h at 1.5×; nothing over 12. Straight hours 40, so no extra weekly overtime. Pay = 40 × $22 + 6 × $33 = $1,078; the overtime premium is $66. Federal-only would give the same here (46 − 40 = 6 h) — but with 8, 8, 8, 8, 12 the state rule pays 4 h of overtime where federal pays none.

Frequently asked questions

Is overtime paid after 8 hours a day?

Only in California, Alaska, Nevada (below 1.5× minimum wage) and Colorado (after 12). Everywhere else only hours over 40 in the week count.

Do bonuses change the overtime rate?

Yes — non-discretionary bonuses, commissions and shift premiums are added to the week's pay and divided by hours to get the regular rate on which the 1.5× is based.

Are salaried employees owed overtime?

If they earn below the FLSA salary threshold or do not meet the duties test for the executive, administrative or professional exemption, yes.

What is double time?

2× the regular rate. Federal law never requires it; California does after 12 hours a day and after 8 hours on a seventh consecutive day.

Can my employer give comp time instead?

Private employers covered by the FLSA cannot substitute comp time for overtime pay; public agencies can under set rules.

Is overtime taxed more?

No, it is ordinary wages. Under the 2025 law up to $12,500 of the overtime premium ($25,000 joint) is deductible on your federal return for 2025–2028 — see the No Tax on Overtime calculator.

Does paid time off count toward the 40 hours?

No — only hours actually worked count under the FLSA; holiday, sick and vacation hours are excluded unless a contract says otherwise.

Are tips part of the regular rate?

Tips received from customers are not; service charges distributed by the employer are.
